GENERAL CONDITIONS OF USE OF THE AENA APPLICATION AND PRIVACY POLICY

1. Purpose

Aena S.M.E., S.A. creates and updates the mobile app identified with the name of Aena on Google Play for Android and the Apple Store for IOS so that the information it contains is of public use.

Access to and browsing this mobile app implies knowledge and unreserved acceptance of all legal information and conditions for its use.

These general conditions have the purpose of regulating access to, browsing and use of this mobile app, however, notwithstanding these, Aena S.M.E., S.A. may establish specific conditions to regulate the use and/or contracting of specific services offered through the app. In the event of any discrepancy between that stipulated in the general conditions and the content of the specific conditions for a particular service, that established in the latter will prevail.

2. Scope of application

This legal notice regulates the use of the Aena mobile app service which Aena S.M.E., S.A. makes available to mobile device users.

Aena S.M.E., S.A. has independent legal status, separate from that of the central government, full legal capacity and ability to act in fulfilment of its purposes, and has its own assets.

3. Liability Waiver

Aena S.M.E., S.A. makes every effort to offer support in the various co-official languages, as well as avoid any errors in the content of the Aena mobile app.

Aena S.M.E., S.A. does not guarantee neither the exactness nor the updated status of the information that may be obtained on this app, which may be modified without notice.

Aena S.M.E., S.A. assumes no responsibility arising from third-party use of the content of this site.

All the information contained (including but not limited to flight times, maps, etc.) are for informational purposes only. Flight information on the Aena app is the most up-to-date available. However, if you want more information about a specific flight, please contact the airline company.

The information provided by Aena S.M.E., S.A. is general and involves no professional or legal advice.

Aena S.M.E., S.A. will make every effort to ensure that the Aena mobile app suffers no interruptions, but cannot guarantee the absence of technological failures, nor the permanent availability of the mobile app and of the services it contains and, therefore, shall not be held liable for any damages that may be incurred due to lack of availability or failures in access caused by disconnection, breakdowns, overloads or network shutdowns for which Aena S.M.E., S.A. cannot be held responsible.

Aena S.M.E., S.A. does not guarantee the absence of viruses or other elements that may alter the IT system affecting your Aena mobile app. Aena S.M.E., S.A. waives any responsibility for damages or loss of any kind due to viruses or harmful elements.

4. Service subscriptions

In general terms, access to the utilities on the mobile app does not require prior subscription or user registration. Notwithstanding the above, access to some of the services that are provided through the mobile app (such as Access to the Aena Customer Club) may require that a subscription form be filled out beforehand. For these purposes, the user guarantees the authenticity and veracity of all the data provided when filling in the subscription form(s), and Aena S.M.E., S.A. will process the data as established in our privacy policy, which is set out in the next section.

Users undertake and are responsible for maintaining all the information that is provided in such a way as to ensure that it reflects their true situation, at all times.

If, as a result of the registration, users are issued a password, they undertake to maintain the password secret and to use it and access such services with due diligence. Therefore, users are responsible for appropriately storing any identification details and/or passwords that are supplied to them by Aena S.M.E., S.A. and for keeping them confidential. Furthermore, they undertake not to allow third parties to use them, either temporarily or permanently, nor to allow other persons access to them. The user will be responsible for the unlawful use of the services by any non-authorised third party who uses a password for said purposes due to the non-diligent use or loss of the password by the user.

5. Privacy policy

In accordance with Personal Data Protection regulations, specifically, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, and Organic Law 3/2018, on the protection of personal data and guarantees of digital rights, we inform you that any personal data that you may provide us with or that may be collected through Cookies in this mobile application will be processed by Aena S.M.E., S.A., in its capacity as data controller, for the purposes indicated below:

  • Whenever you have enabled location services (settings option on your device), Aena will collect information on WiFi access points or relating to latitude and longitude in order for this information to assist us in showing your location so that we can provide you with our services. This processing is based on your consent (by giving permission to the app to access your device’s geolocation data). Consent can be withdrawn at any time by disabling the corresponding option in the app settings or by withdrawing the device's permissions to the app.
  • With regard to the “My Trip” service, Aena will read your boarding pass in order to keep you informed of the status of your flight by means of push notifications, and uses the app to show, if you do so voluntarily through the app, your boarding pass when you pass through the security checkpoint or boarding gate, processing based on your consent when you select this option. The data will be retained in the application for the duration of your flight and will not be communicated to any third party or transferred internationally. You may at any time remove your flight data from the app by selecting this option, thereby withdrawing your consent. If you show your boarding pass when passing through the security checkpoint or boarding gate, the data will be communicated to your airline or handling agent acting on behalf of your airline, for the performance of your contract of carriage, as well as to the State Security Forces and Corps for the purposes of prevention of a real and serious danger to public safety or for the repression of criminal offences, following the formal requirements of the Spanish Data Protection Agency, and for compliance with legal obligations (National Security Programme and Regulation (EU) 2015/1998), and to Customs Authorities (for compliance with legal obligations). Using this option, you can also manually link your boarding pass to your biometric profile, provided that the service is active at the airport and you have registered for it.

  • With regard to PRM Services, we inform you that the data you provide us with through the form provided for this purpose in the Aena mobile application will be used to manage the service you request for assistance to persons with reduced mobility (based on the execution of the contract), as well as to carry out a satisfaction survey to improve the service (based on legitimate interest).
  • Regarding the Guidance Service, it offers a geopositioning, guidance and route calculation solution to its passengers. Finally, information on times to destinations, inside and outside the airport, will be provided on the basis of the data subject’s consent.

    As a user of this service, the data that Aena will process are those related to your device and its positioning within the airport, i.e.:

    • Unique device ID.
    • Device type (iOS/Android).
    • Coordinates (x,y).
    • Coordinate accuracy.
    • Airport where you are located.
    • Building and floor on which it is located.
    • Route mode (yes/no).

    In addition, it will provide information on the routes most frequented by passengers in order to improve the services provided and adapt the commercial offer at the different airports, on the basis of Aena’s legitimate interest in improving the provision of its services.

    Consent to these functions is given by enabling access to geolocation services on your device or by authorising your geolocation by any other means (by enabling/disabling location services by configuring this option in the settings of your device or the application).

    The data subject has the right to withdraw the consent given at any time. To do so, you can withdraw consent directly through the application itself, by disabling the location access option in the Aena application settings, or directly in your device settings by removing permissions to this application, or by uninstalling it from your device.

At the same time, and with your permission, we will send you commercial and advertising communications by sending messages (push messages) to your mobile device, such as promotions and discount vouchers from Aena airport shops or from third parties in the following areas or sectors: cars and vehicle hire, leisure, travel agencies, tourism, transport, airlines, catering, the textile industry, fashion, beauty and cosmetics, finance and insurance, press and magazines, and gambling. You can disable the receipt of these messages at any time by disabling this option in the settings of the application itself.

Your data will be retained while necessary to comply with the purpose for which they were collected.

Your data may be communicated to Aena Sociedad Concesionaria del Aeropuerto Internacional de la Región de Murcia S.M.E., S.A., in the case of requesting a service for the Aeropuerto Internacional de la Región de Murcia, a subsidiary company of Aena that manages said airport, for the provision of the service; to your bank, for the collection of the payment for the service provided.

They are subsequently stored for as long as claims and obligations may arise as a result of the processing of your data for the purpose for which they were collected. 

It is anticipated that the following parties will receive your data: 

  • To entities involved in Administrative and Legal Proceedings (where appropriate).
  • To Courts (where appropriate).
  • Security Forces and Custom Authorities, to comply with legal obligations.
  • To your bank or savings bank to pay for the services provided.
  • The State Air Security Agency (AESA) for inspections (where appropriate).
  • Your airline, if necessary.
  • Your data will be transferred to Aena Sociedad Concesionaria del Aeropuerto Internacional de la Región de Murcia S.M.E, in the event that you book a service for the Airport through the app.
  • Other entities that may be involved in processing your claim or complaint.
  • Persons, institutions or authorities that may require them by law.

Aena S.M.E., S.A., as the data controller, will adopt the technical and organisational measures necessary in order to guarantee the security of the personal data you provide to us, preventing their loss or unauthorised alteration, manipulation or access.

Any data subject is entitled to receive confirmation as to whether or not his or her personal data are being processed. The General Data Protection Regulation also stipulates the following rights for the data subject:

  • Access to his or her data.
  • Requests for rectification or deletion of his or her data.
  • Requesting that the processing of his or her data be restricted.
  • Portability of his or her data.
  • Objection to his or her data being processed.

Requests will be answered as soon as possible and, in any event, within one month of receipt. The above time limit may be extended for a further two months where necessary, depending on the complexity and volume of requests. Aena will notify the interested party of the extension within the first month from the time of the request.

The interested party is entitled to withdraw consent to commercial correspondence at any time, without this affecting provision of the contracted service. 6. Intellectual and Industrial Property Rights

Aena S.M.E., S.A. is the holder of the intellectual and industrial property rights of the Aena mobile app, as well as of its content.

The texts, designs, images, databases, logos, structure and other elements of this site are protected by intellectual property laws and international treaties. Any reproduction, transmission, adaptation, translation, modification, public communication, or any other use of the content, either whole or in part, of this website, carried out by any means or through any medium, electronic, mechanical or otherwise, is strictly prohibited, except with prior written authorisation from Aena S.M.E., S.A. Any infringement of these rights may lead to due legal proceedings.

7. Applicable law and authorised jurisdiction

The use of elements from this site implies acceptance of the legal warnings expressed herein and, more particularly, any disputes related to this site will be governed exclusively by Spanish law, the Spanish Courts and Tribunals being the only applicable authorities.

8. Modification of these conditions and warnings

Aena S.M.E., S.A. reserves the right to modify the conditions and warnings applicable to this mobile app.

Flight information

The flight information contained in this app is the most up to date that is available. It is based on confirmed operational data and estimates provided to Aena S.M.E., S.A. by the airline companies.

Aena S.M.E., S.A. makes every effort to ensure its reliability and that it is immediately updated. However, if you want more information about a specific flight, please contact the airline company.

For information on the check-in times and the time you should arrive at the airport before the scheduled flight departure time, we recommend that you contact the airline operating the flight.

If you are a passenger or accompanying a passenger and look at the Aena mobile app before going to the airport, take into account that flight information is updated in real time and may change during your journey. Please contact the airline company to confirm these details.
